YAKIMA, Wash. -- A second suspect in last month's shooting outside The Seasons Performance Hall might soon be convicted for burglary.

Twenty-year-old Luis Rodriguez-Perez was in a diversion program on a two-year-old burglary charge. That means he had to keep his nose clean for the charge to be tossed.

Now, prosecutors hope to revoke that diversion agreement for an immediate conviction on burglary. A judge will hear the motion next month.

Rodriguez-Perez is charged with second-degree murder for the deadly shooting in March.
