Pot shop kicked out of Yakima moves to the county
YAKIMA, Wash. -- There's another gray area on marijuana laws. The state says collective gardens are legal. Federal and city laws say they're not.

A collective garden was kicked out of Yakima last month. KIMA learned Green Valley Wellness is now expecting to open in the county.

The owner told Action News they are working on getting their permits. Yet if Yakima County doesn't approve it, it will not be permitted to open. The city will not sign off on any marijuana dispensary or garden.

"State law is state law," said Attorney Jay Berneburg. "The county can't say differently and a city can't say differently. In terms of whether this is a lawful or unlawful in a criminal sense -- it is 100% lawful."

The owners plan to open their doors in the next month. They wouldn't disclose their exact location. They will have to tell the county if they want to get that permit.
