A district court judge ruled the family of a Richland man shot and killed by Kennewick police in 2009 may continue.

Judge Rosanna Malouf Peterson ruled the plaintiff may pursue a municipal liability claim in a summary judgment filed Wednesday.

The family of Christopher Villarreal is seeking damages against the city. A Kennewick police officer shot and killed Villarreal during a traffic stop.

The officer said he opened fire when Villarreal tried to ram his car backward into the officer's motorcycle.

In 2010, the FBI investigated and the Department of Justice looked into the officers actions. They determined Officer Lee Cooper did not violate policy.

An independent review board also ruled the shooting was justified.

No charges were filed against Cooper.
