YAKIMA, Wash. -- A man shot in broad daylight on the streets of Yakima survived emergency surgery Monday. KIMA was on the scene at 40th Avenue where the shooting happened around 9 a.m. Detectives say he was shot by one of his fiancée's relatives.

"He advanced my sister and my sister shot him," said Garrett Call, the suspect's brother.

One shot that hit Jason Layman in the stomach. But it's what happened before the yellow tape went up that police are still investigating.

Police said a woman and her boyfriend were arguing over their child. The woman's aunt came to pick them up and another argument began between the aunt and boyfriend.

Police said the aunt pulled the trigger, but it's too early to tell if she was just protecting herself.

This isn't the first time they've had to show up at this house for other domestic violence issues, according to police. Neighbors say they hear the couple fighting all the time

"There is definitely some history here," said Rod Light, Yakima Police Lieutenant. "There is. We have been here before."

The suspect's brother said she pulled the trigger in self-defense.

"He's called me bad names," Call said. "And he's pulled my daughter's hair before. Beat her up and stuff."

The aunt was taken in for questioning, and her red van was brought to the police department to be be searched. But, police say they will likely not book her into jail.

The couple's child is caught in between. Police handed the child over to Child Protective Services where the grandparents are expected to pick him up.

"I didn't want something like this to happen," Call said.

Police say they expect Jason Layman to survive. Action News will keep you posted on any charges.
