Police: Woman who shot niece's boyfriend may not be charged
YAKIMA, Wash. -- A woman who police say shot her niece's boyfriend in broad daylight might not be charged with a crime. That shooting happened Monday morning on 40th Avenue.
Investigators won't file charges if they determine she acted in self defense.
Yakima police tell us detectives are still putting together what happened from witnesses.
It's ultimately up to prosecutors to press charges. Police provide the evidence for the decision.
"Really these cases are case by case, and in that moment, in that time, based on what the person knew and believed to be true," said Lieutenant Mike Merryman of Yakima Police. "That's really what we look at, is what level of threat they thought would be used against them or the person they were trying to protect."
The woman police say shot Jason Layman yesterday remains free unless prosecutors decide to pursue a criminal case.
