YAKIMA - Yakima County Prosecutor Jim Hagarty's breathalyzer results show his alcohol content was above the legal limit.

The Washington State Patrol arrest report indicates Hagarty blew twice into the device. One test came back with a breath alcohol concentration [BAC] of .106 and the other showed a BAC of .109. The legal limit in the state is .08.

Action News learned the Kittitas County Prosecutor's Office will be handling the case.

Washington State Patrol picked up Hagarty Tuesday night after he got into a car accident in Selah.

Kittitas Deputy Prosecutor Paul Sander says no formal paper work was filed, but Yakima's prosecutor's office made the request Wednesday.
