Safeway shooting charges dropped

YAKIMA, Wash. -- KIMA has learned that the man arrested in connection with last week's shooting at a Safeway parking lot is being released from jail.
Yakima County prosecutors confirm they decided not to charge Anastacio Lepe at this time.
Police say Lepe shot Jaime Partida in a dispute over a cell phone. Lepe's lawyer claims his client acted in self defense when Partida stole the cell phone and reached for something that could be a gun.
Yakima detectives say the decision not to press charges came before they could talk to the victim.
